Kanye West and Kim Kardashian will not face criminal charges for recording a seemingly private conversation with Taylor Swift.

Normally, in the state of California, if a person records a private conversation without the other person’s consent, it’s illegal. But TMZ reports the law doesn’t apply if that person knows that other people may overhear them. In this case, since it was on speaker phone and hip hop producer Rick Rubin is heard in the background as well, criminal charges are a no-go.

‘Ye’s The Life of Pablo, which was released in February, held the song in question, “Famous,” that gained a lot of flack for its lyrics. In the song, Ye raps “I feel like me and Taylor might still have sex / Why? / I made that bitch famous.”

When the song came out the pop queen was reportedly livid and told fans that she was blindsided by the song. But now after five months and undoubtedly some appointments with their legal team, Kim K released the video that proves that Swift knew about the lyric — and approved it.

It seems that Taylor Swift will have no luck if she proceeds with a court case against the West/Kardashian crew.

What do you think? Was it wrong to record the conversation or nah?
